After selling for half a year, the infringing seller finally received a freezing notice?

A shoe design brand filed an infringement lawsuit in December 2020 , but for some reason, the defendant seller's funds were not frozen at the time, so many sellers did not take the initiative to contact the brand for processing. However, more than half a year later, the default judgment was issued on July 28 this year, and some sellers have already received a freezing notice.

 

It is reported that this shoe design brand is SU.CHENY , and the brand owner is SUN CHENYAN. The brand focuses on exquisite and dreamy wedding shoes.

 

As early as 2019, SU.CHENY filed a lawsuit for infringement. In August of the same year, it sued 9 stores, including 4 eBay stores, 4 Wish stores and 1 AliExpress store. In September, it sued 8 Wish stores. At that time, the main lawsuit was copyright infringement, that is, other sellers misappropriated SU.CHENY's various wedding shoe design pictures without its consent.

In 2020, SU.CHENY launched several infringement lawsuits. In last year's infringement cases, the brand not only sued for copyright infringement, but also sued for trademark infringement, which shows that its rights protection efforts have been further strengthened.

 

The United States Patent and Trademark Office shows that the trademark SU.CHENY was registered on July 9, 2019.

 

 

The most recent one was on December 18, 2020, with case number 20-cv-7492. The complaint lists 31 infringing sellers, including some stores on platforms such as eBay and Wish, as well as multiple other shopping websites.

 

In fact, in March last year, Dunhuang.com also received a complaint from the brand that some of its sellers sold products that infringed its intellectual property rights. At that time, Dunhuang.com issued a warning announcement, saying that it hoped that sellers would conduct self-inspections of their store product information (including products that have been removed from the shelves). If, during the monitoring or review process, it is found that the seller's account has infringement issues, the platform will punish it according to relevant rules. For serious violations, the platform will directly impose a penalty of closing the account.

 

After more than half a year, another seller received a freeze notice. This is a reminder to all sellers that when faced with infringement lawsuits, they must deal with them in a timely manner, otherwise they will still face penalties and even suffer greater losses. Of course, if you want to gain a firm foothold in the industry, compliance operations and independent innovation are the key.
