Yesterday ( September 22), Canon Inc. issued an announcement, announcing that it had submitted an infringement report to Amazon, requesting Amazon to remove some infringing toner cartridges on Amazon.com.
This infringement report involves five brands, Uniwork, V4INK, Colorking, LxTek, and CMYBabee, as well as five sellers, Jaylantechshop, Numerator, COLORKING DIRECT, yatotrading us, and xujia amzusa. The ASINs involved are: B07V5LXWC5, B07S22SJ5L, B09NSQQ2YN, B0851VSRT3, and B07XKQS PJN. Canon claims that these products infringe Canon's U.S. Patent No. 11,169,483.
It is reported that the infringement case started in March 2021 when Canon filed an infringement lawsuit, which triggered an investigation into infringing products, including manufacturers, importers and distributors of toner cartridge supply containers.
At the beginning of this year, the administrative law judge who presided over the investigation determined that Canon had proved that the subject of the investigation had infringed its patent rights, and the US International Trade Commission (ITC) adopted these findings. Therefore, in April, Canon announced that in the first quarter of this year, it had removed 48 infringing products from Amazon in the United States, Canada, Mexico and other places; and removed 628 infringing products from Germany, Italy, Spain, the United Kingdom, France, the Netherlands and other places.
Then in July, Canon announced that in the second quarter of this year, it had successfully removed 46 infringing products from Amazon in the United States, Canada, and Mexico, and successfully removed 956 infringing products from Amazon in Germany, Italy, Spain, the United Kingdom, France, and the Netherlands. This time, some infringing products have been seized and are facing the result of being removed from the shelves.
In fact, Canon has always paid special attention to its patent rights. Since 2018, it has frequently filed lawsuits against other toner cartridge infringing products and won.
According to Canon's statistics, since June 2018, Canon has removed a total of 27,890 infringing toner cartridges from Amazon in Germany, Italy, Spain, the United Kingdom, France and the Netherlands; a total of 3,310 infringing toner cartridges from Amazon in the United States, Canada and Mexico; and to date, Canon has successfully removed more than 30,000 infringing toner cartridges from Amazon platforms around the world.
In this case, it can be predicted that Canon will continue to focus on protecting its rights in the future. In addition to Canon, major overseas brands and law firms are also further increasing their efforts to protect their rights, and major cross-border e-commerce platforms are also strengthening the control of infringing products.
Therefore, when selecting products, sellers should pay attention to possible infringement issues of products in the supply chain. At the same time, they should also regularly check all online products in their stores to see if they have infringed copyright. Amazon Removed |
