After the infringement was removed from the shelves, the seller's account was still suspended

Infringement is a taboo for Amazon sellers. If there is an infringement complaint, in addition to removing the relevant products from the shelves, it is also necessary to negotiate with the complainant to resolve the issue. This is the only complete solution. Simply removing the products from the shelves is not enough. Recently, a seller shared his case, in which his account was suspended two months later because he did not handle it properly.

The seller received the infringement notice on ASIN on September 19 this year , and then deleted all related content as if nothing had happened. The seller's account continued to operate normally for a while, but after nearly two months, the seller received a notice that his account was suspended.

The email showed: " We are writing to inform you that the selling rights in your seller account have been suspended. We took this action pursuant to a temporary restraining order issued by a federal court , prohibiting items that infringe on the copyrights, patents, trademarks, design rights, database rights or other intellectual property rights of others . " The seller contacted the plaintiff but received no response.

According to the seller’s reply, the plaintiff is “Peanuts Worldwide LLC”, which has many IP characters, of which the two main characters Charlie Brown and Snoopy are the most famous, and there are a large number of product categories under its brand. It seems that the seller has offended a big brand.

In this case, the seller was the first to infringe on the rights, and the seller simply deleted the product link without any other response. Moreover, the infringing brand is a big brand, so the only thing the seller can do is to minimize his losses through legal means.

In addition, the editor found out while browsing related news that this seller is not an isolated case. Recently, the company has launched a large-scale case of infringement, and nearly 200 sellers have been sued , involving AliExpress, Amazon, and eBay platforms, most of which are Amazon sellers. Sellers should also take this as a warning, and big brands should never be touched.

Infringement is not a trivial matter. Before it is discovered, it can be simply removed from the shelves. However, if you receive an infringement notice, you must contact the complainant in time to negotiate to avoid suffering greater losses. Of course, the safest thing is to develop a good awareness of intellectual property rights. Crooked ways are not advisable.
