The ruling was made in the U.S. District Court for the District of Arizona, where Temu also filed an emergency motion seeking a temporary restraining order and preliminary injunction against the defendants, led by dltemuapp.com.
According to Peng Newspaper, when the motion was finally granted, the defendant's website did not respond to the order, so the court considered it a waiver of the dispute over the motion and recognized the claim. The lawsuit was filed earlier this month, a move that shows Temu is stepping up its efforts to protect its trademarks. In the complaint filed with the court, Temu mentioned more than 20 website domains, such as "temuapp.biz" and "temucouponcodes.com", alleging that they used the platform's trademarks to create domain names, impersonate applications and online markets, and use fake coupon codes and other promotions to mislead customers.
Temu alleges that the websites engaged in “trademark infringement, improper identification, and false domain names.” Temu also seeks $100,000 in damages for each use of a counterfeit Temu trademark.
A Temu spokesperson said that the actions of these fake websites not only damage the platform's reputation, but also harm consumers who think they are using the genuine Temu platform; the platform will take legal action quickly to defend its rights and protect customers from such malicious and illegal activities.
