What's going on? The seller was accused of counterfeiting by the partner

When doing cross-border business, especially on the Amazon platform, the first thing sellers need to solve is brand and trademark issues. They must avoid the risk of infringement and effectively protect their rights when they encounter infringement. They must not only be wary of other sellers, but also communicate well with cooperating manufacturers.

 

There have been cases where sellers’ products were sold by cooperating manufacturers on other platforms before, and now there are sellers who have been reported by cooperating manufacturers for selling counterfeit goods. Recently, a seller shared his own case on Amazon:

 


The manufacturer mainly produces laser parts. The seller has been purchasing orders from the manufacturer for a long time. He not only sells on his own website, but also on Amazon and eBay. The cooperation has lasted for five years. However, the seller recently received an email, which did not accuse the seller of intellectual property infringement, but accused the seller of selling counterfeit goods.

 

The seller's large number of purchase orders, payment orders and email exchanges can prove that they are not selling counterfeit goods. The seller has submitted a relevant proof appeal and is waiting for the result reply. According to the seller's later reply, the cooperative manufacturer has always known that the seller sells online. If it cannot operate on certain platforms, it should have given an explanation.

 

Sellers also expressed their opinions below, such as whether they have obtained written approval for LOA to sell on the Amazon platform , and whether the Amazon ID can show the seller's identity, etc. These are all possible situations. If it is the former, then the seller does not have the authority to sell on Amazon. If it is the latter, it can be well resolved through communication between the two parties.

 

The seller has not responded to the real situation of this incident, but this case is also a wake-up call for sellers. Before putting products on the shelves, they must do a good job of brand protection. If it is an authorized product, the corresponding materials must also be prepared. When signing a contract with a cooperative manufacturer, important matters should be stated in the regulations to prevent unnecessary losses.
